Terms of Service

These Terms govern use of Hurrah Reviews (“the Service”), provided by OPT Digital Limited trading as Hurrah. By creating an account or using the Service, you agree to these Terms.

1. The Service

Hurrah lets businesses send review-request emails and SMS messages to their customers, manage incoming reviews, and route negative feedback privately. The Service is provided as-is on a subscription basis with a 14-day free trial.

2. Your account + your responsibility

  • You must be authorised to act on behalf of the business named in your workspace.
  • You are responsible for the legality of every contact you upload — you must have a valid sending basis (express consent, prior business relationship, or another lawful basis under the recipient’s jurisdiction).
  • You are responsible for the content of templates you send. We reserve the right to suspend accounts that send messages that breach CAN-SPAM, AU Spam Act, NZ UEMA, CASL, or any equivalent law.
  • You must keep your login credentials confidential and notify us immediately of any unauthorised use.

3. Acceptable use

You agree not to use the Service to:

  • send unsolicited commercial messages or messages without a lawful basis;
  • impersonate another business or individual;
  • send to recipients you obtained from purchased, scraped, or rented lists;
  • continue sending after a recipient has unsubscribed or otherwise opted out;
  • send messages containing illegal, deceptive, threatening, or harmful content;
  • circumvent rate limits, abuse the API, or interfere with the Service.

4. SMS Program

Hurrah Reviews offers an optional SMS messaging program (“Hurrah Reviews SMS”) that allows workspace owners to send review-request text messages to their customers. By enabling SMS in your workspace, you confirm that you have obtained valid consent from each contact to receive commercial SMS, and that you have a lawful basis for each send under the recipient’s jurisdiction (NZ Unsolicited Electronic Messages Act, Australian Spam Act, US TCPA, or equivalent).

Program name: Hurrah Reviews SMS. Message frequency: low — typically 1 to 3 messages per customer per review-request cycle. Message and data rates may apply.

Recipients can reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT at any time to opt out of all further SMS from the workspace that messaged them. Recipients can reply HELP for support information. For other questions, contact support@hurrahreviews.com.

5. Pricing + billing

Subscriptions are billed in advance via Stripe in the currency shown at checkout. Trials auto-convert to a paid subscription at the end of the trial period unless cancelled. You may cancel any time via the billing page; cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds.

6. Suspension + termination

We may suspend or terminate access immediately if (a) we detect abuse per §3 above, (b) deliverability metrics for your workspace are materially harming our shared sending infrastructure (typically complaint rates above 0.30%), (c) payment fails for more than 14 days, or (d) we are required to do so by law. Whenever practical we will notify you first.

7. Liability

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. Hurrah’s aggregate liability for any claim arising out of these Terms is limited to the fees you paid in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or punitive damages, including lost revenue, lost reviews, or reputational harm.

Nothing in these Terms limits any consumer rights you have under the New Zealand Consumer Guarantees Act 1993, the Australian Consumer Law, or equivalent legislation that cannot be contracted out of.

8. Indemnity

You agree to indemnify Hurrah against any claim arising from your use of the Service in breach of these Terms or any law — including spam-law penalties, privacy-law penalties, or third-party claims by recipients of your messages.

9. Changes

We may update these Terms; material changes will be notified at least 30 days before they take effect. Continued use after the effective date is acceptance.

10. Governing law

These Terms are governed by the laws of New Zealand. Disputes go to the courts of New Zealand, except where consumer-protection statutes in your jurisdiction grant you a non-waivable right to a different forum.
